Does a will help you avoid probate?
People are often surprised when I tell them their will is not valid until it is filed with the probate court. “But why would it need to be filed with the court? I thought wills avoided probate!” In fact, your will is not valid outside of court! If your executor tried to sell your house without a formal appointment from the appropriate probate court (typically called Letters Testamentary) they will have no authority. So not only does a will not help you avoid probate – it actually forces you to go to probate court.
